Disqualification of Attorney General Michael B. Mukasey Sought in RICO Case

KANSAS CITY, MISSOURI -- Disqualification of Attorney General Michael B. Mukasey is sought by the plaintiff Samuel Lipari for Mukasey's representation of Bradley J. Schlozman, the former US Attorney for the District of Western Missouri. Schlozman is a defendant in the RICO lawsuit for interfering in ongoing federal civil litigation over the Novation LLC hospital supply monopoly created by Jeffery Immelt of General Electric Company (GE) and Curt Nonomaque of Texas based VHA, Inc. The lawsuit filed in June of 2003 by Samuel K. Lipari of Lee's Summit, Missouri is currently captioned Lipari v. General Electric Company, et al, W.D. of Missouri Case No. 07-0849-CV-W-FJG and is being presided over by the Hon. Fernando J. Gaitan, Jr., Chief Judge of the US District Court for the Western District of Missouri.

A motion to disqualify Attorney General Michael B. Mukasey from continuing to act as defense counsel for Bradley J. Schlozman in the RICO (Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. § 1961-1968) case was filed on September 2nd, 2008. Missouri's current US Attorney John Wood admitted in a filing to the court on August 8th, 2008 that he had been "…authorized by the Department of Justice, on March 24, 2008, to provide individual capacity representation to Bradley J. Schlozman, former Interim United States Attorney, Western District of Missouri".

The motion Samuel Lipari filed to disqualify Attorney General Michael B. Mukasey is based in part on US Attorney John Wood claiming to have settled without litigation a criminal Medicare fraud prosecution of Springfield Missouri hospital chain CoxHealth and its CEO Robert H. Bezanson for an agreement to pay $60,000,000.00 in fines. The Medicare fraud prosecution of CoxHealth was initiated by Schlozman's predecessor Todd P. Graves. The lawsuit documents why Todd P. Graves was unlawfully removed as US Attorney for the Western District of Missouri for initiating the prosecution of CoxHealth and replaced by Bradley J. Schlozman. Later Todd P. Graves was discovered to be the "Ninth US Attorney" to be illegally fired.

Samuel Lipari's motion argues that past criminal case law clearly establishes that Attorney General Michael B. Mukasey and US Attorney John Wood cannot participate in the Medicare fraud racketeering conduct of Bradley J. Schlozman and at the same time be Bradley J. Schlozman's defense attorneys.
