Dulles Toll Road Users

NORTHERN VIRGINIA -- In a class action filed today in the United States District Court for the Eastern District of Virginia in Alexandria, Dulles Toll Road users John Corr and John Grigsby, both long time residents of the Commonwealth of Virginia, have challenged the authority of the Metropolitan Washington Airports Authority (MWAA) to set tolls for the Dulles Toll Road.

The suit alleges that setting tolls in excess of what is needed pay for toll road expenses amounts to a tax. As an unelected entity that is independent of the Federal, State or local governments - that is, an entity totally beyond any control by the voters who have to pay this tax - MWAA cannot constitutionally be given such a power under both the Virginia and United States Constitutions.

The lawsuit seeks to have this illegal exaction stopped and a refund of the amounts of the tolls above what would have been collected under the toll rates in effect before the 2005 toll increase.
